Asked by: Praveen  — 19 November, 2012

Dear Sir,

I am planning to set up a small company in India to run a small US Based Sales Process. It is a Pvt. Ltd. Company. I would like to open a LLC in state of Delaware. I have few questions regarding this issue.

1. Is my physical presense required there?
2. Do we need a office in Delaware or Virtual Address will work?
3. Do we need a bank in USA?
4. If yes, how do I go about it as I am not located in USA.

Looking forward for your prompt reply

Thanking You,
Praveen

Praveen,

No problem, we can definitely assist you in registering your LLC in Delaware.

You are not required to have any physical presence in the state or country to register your business. You do not have to submit any identification documents, nor do you need to have a U.S. address to form the business. (You may use a home or office address in India, and you may even list a company in India as the owner of a U.S. company).

If you wanted to have a U.S. address, you may use a virtual office address to apply for the business with. We have some recommendations and comparisons of service providers of virtual offices under our article ‘U.S. Business Address‘.

You are not required to have a bank account in the U.S. to register the company, and once the company is formed, you may be able to operate the company from India without opening a U.S. bank account. The best suggestion would be to consult international banks in your area, such as Citibank, HSBC, Bank of America, etc., and see if they would open a USD account for your U.S. business if you have the appropriate documents and international certifications. We have other suggestions and information in our article ‘U.S. Bank Account‘.
