Hiring someone in the US

Asked by: Shanker  — 25 December, 2012

Hi,

I have a real estate business in India and we are interested in promoting, advertising and selling this real estate in the US market, to NRI’s. We are looking to hire someone locally (in the US) to help with this. I was wondering how to go about that – what steps will I need to take; what tax laws might come into effect etc.

Thanks,
Shanker

Shanker,

Registering the business will be very easy, as you will not be required to have a U.S. address, social security number, nor would you be required to submit any financial or identification documents. You would be able to apply directly online, and use a home or office address in India as the business address.

We have a research article specifically for international residents, titled ‘U.S. Companies for Foreigners‘, which compares the different entity types you could register, as well as offers a side-by-side comparison of the top recommended states, which would guide you to the online applications depending which entity type and state fit your business plans best, respectively.

Regarding employees, it will be very easy I am sure using staff search agency services or even self-promotional ad sites such as Craigslist to find a U.S. resident willing to take a job. There are no shortages of unemployed Americans these days, that’s for sure!

Typically, your business will need to be registered in the state where you have employees, so it may be a good idea to search in the state where you register the company for potential employees for your business. You could, of course, hire those individuals not as employees but as independent contractors, in which case you have more flexibility in terms of business registration in the U.S.

In regards to taxes and such, that is best consulted with a licensed accountant, respectively.
