Is DBA necessary?

Asked by: Natalia  — 6 March, 2011

I’m starting a business. It’s a general partnership. I have an EIN. Do I also need a DBA? The name of the business is fictitious.

Dear Natalia,

If you are conducting business under a fictitious name, you should register a DBA. However, since you are already going through the trouble of registering your business, why not think about forming an LLC. An LLC will give you all the benefits of a partnership, it will automatically be registered under a separate name of your choosing, and in addition an LLC will provide you and your partners with limited liability protection for your personal assets. It may be a smart and efficient solution.
